1. Acceptance of Terms
By accessing this website or placing an order with Modern Apothecary (“Modern Apothecary,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions (“Terms”), our Privacy Policy, and any other policies referenced herein. If you do not agree to all of these Terms, you must not access the site or place an order.
2. Research-Only Products; Eligibility
All products sold by Modern Apothecary are sold strictly for legitimate laboratory research, development, and analytical use only. No product is approved by the U.S. Food and Drug Administration (FDA) and none is intended for human or animal consumption, diagnosis, cure, mitigation, treatment, or prevention of any disease or condition.
By placing an order, you certify and affirmatively agree that:
- You are at least 21 years of age and legally capable of entering into a binding contract;
- You are purchasing solely for lawful laboratory or scientific research and development purposes;
- You have the training, judgment, secure storage, and equipment necessary to safely handle the materials ordered;
- You will not resell, export, repackage, compound into a finished formulation or supplement, or otherwise redistribute any product for human or animal use; and
- You will handle, store, and dispose of all materials in full compliance with applicable federal, state, and local law.
3. Age Verification and Minor Purchases
Modern Apothecary sells only to individuals 21 years of age or older. By checking out, you affirm your age and the accuracy of all information you provide. We reserve the right to require government-issued identification or an adult signature upon delivery.
If we discover that a minor has placed or received an order, the order may be canceled and the products recalled. Any refund will be issued only after the products are safely returned or their destruction is verified. Modern Apothecary assumes no liability for false statements made during checkout or for unauthorized purchases made by a minor using another person’s information or payment method. The individual who completed the order agrees to indemnify Modern Apothecary against all claims, costs, or losses arising from such a transaction.
4. Prohibited Uses
Products purchased from Modern Apothecary may not be:
- Consumed by, or administered to, humans or animals;
- Used for diagnostic, therapeutic, cosmetic, veterinary, or agricultural purposes;
- Compounded, formulated, or repackaged into a drug, supplement, or cosmetic product;
- Marketed, resold, or distributed for any purpose other than laboratory research; or
- Used, directly or indirectly, in the development, production, or testing of a chemical or biological weapon, or exported in violation of U.S. export-control law.
Any communication, order note, review, or account activity indicating an intended use outside these Terms may result in order refusal, account suspension or termination, and, where appropriate, a report to relevant regulatory or law-enforcement authorities.
5. Regulatory Compliance and Import/Export Responsibility
You are solely responsible for understanding and complying with all laws applicable to your possession, import, receipt, and use of any product you order, including the laws of your state and locality. Modern Apothecary makes no representation or warranty that any product is lawful to purchase, receive, or possess in every jurisdiction, and we reserve the right to refuse or cancel any order that appears to violate applicable law or that we believe presents a regulatory or misuse risk.
6. FDA and FTC Disclosures
Statements made on this website or in related marketing materials have not been evaluated by the FDA. No product sold by Modern Apothecary is intended to diagnose, treat, cure, or prevent any disease. Product descriptions and literature references are provided solely to identify chemical and research properties and do not constitute medical, dosing, or usage advice for human or animal application.
Modern Apothecary does not solicit, endorse, or permit customer testimonials, reviews, or third-party content that imply a health, performance, or cosmetic benefit from any product. Posting such claims on our site, social media, or in communications with us may result in removal of the content and permanent account termination.
7. Assumption of Risk
Handling research chemicals carries inherent risks, including but not limited to chemical exposure, improper storage, and misuse. By purchasing from Modern Apothecary, you acknowledge that you are qualified and equipped to safely handle the materials ordered, and you assume full responsibility for any injury, loss, or damage arising from their handling, storage, or use. You waive and release Modern Apothecary and its affiliates, officers, employees, and suppliers from all liability related to such risks.
8. Product Information Disclaimer
All information on this website is provided “as is” and “as available.” While we strive for accuracy, Modern Apothecary makes no warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Any research or use of our products is undertaken entirely at your own risk. Product images and descriptions are representative and actual products may vary slightly (e.g., lot-specific labeling, packaging updates).
9. No Medical, Legal, or Scientific Advice
Content on this website — including product pages, blog posts, FAQs, and customer communications — is provided for general informational purposes only and does not constitute medical, legal, or scientific advice. You should consult a qualified professional before relying on any content from this site in a research or other setting.
10. Orders, Pricing, and Payment
We accept the payment methods listed at checkout, which may include credit/debit cards, ACH or bank transfers, and cryptocurrency. Prices, availability, and accepted payment methods are subject to change without notice.
All transactions are subject to verification. We may decline, delay, or cancel any order suspected of fraud, regulatory risk, or an underage or otherwise ineligible purchaser, at our sole discretion and without liability to you.
Chargebacks and disputes. Placing an order is a commitment to pay the stated price. Unwarranted chargebacks or payment disputes may be treated as fraud. By ordering, you authorize us to share relevant transaction data with our payment processors and, where legally necessary, with law enforcement. Abuse of chargeback systems may result in permanent account termination, referral to a collections agency, and pursuit of available legal remedies.
11. Shipping and Adult Receipt
Modern Apothecary currently ships only within the United States. We do not knowingly accept or fulfill orders originating from, or intended for delivery outside, the United States.
We may require an adult signature or additional age/identity verification at delivery. Failure to provide requested verification may delay delivery, void refund eligibility, or result in additional reshipment fees. Shipping timelines provided at checkout are estimates only and are not guaranteed.
Risk of loss and title to products pass to you upon our delivery of the package to the carrier. We are not responsible for delays, loss, or damage caused by the carrier, customs, or other circumstances beyond our reasonable control. It is your responsibility to confirm that the products you order may lawfully be shipped to and received at your address.
12. Returns, Refunds, and Exchanges
Because our products are temperature- and environment-sensitive, we generally cannot accept returns or issue refunds for change-of-mind, buyer’s remorse, or ordering errors, due to the risk of degradation once a product leaves our facility.
Damaged or defective items. If a product arrives damaged, incorrect, or defective, contact us at cs@themodernapothecary.org within 14 days of delivery with your order number and photos documenting the issue. Once verified, we will replace the item or issue a refund at our discretion. Approved exchanges include a prepaid return label for the defective item, and we will dispatch the replacement promptly. No restocking fee applies to approved returns or exchanges.
We are not responsible for degradation or damage resulting from improper storage or handling after delivery.
13. Account Terms
If we offer account creation, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate an account at our discretion for suspected misuse, fraud, or violation of these Terms.
14. Intellectual Property
All content on this website — including text, graphics, logos, product photography, and The Modern Apothecary name and marks — is owned by or licensed to Modern Apothecary and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent. Nothing on this site or in a product listing grants you a license to use any product in a way that would infringe a third party’s patent or other intellectual property rights.
15. Third-Party Links
This site may contain links to third-party websites for convenience only. We do not review, endorse, or control those sites and are not responsible for their content, products, services, or privacy practices. Use of any linked site is at your own risk.
16. Website Availability
This website is generally available at all times but may be unavailable periodically for maintenance, updates, or reasons outside our control. We are not liable for any damage arising from an interruption, suspension, or termination of the site or its services.
17. Limitation of Liability
To the fullest extent permitted by law, Modern Apothecary’s total liability for any claim relating to a product, purchase, or use of this website shall not exceed the amount you paid for the product giving rise to the claim. In no event will Modern Apothecary be liable for indirect, incidental, special, punitive, or consequential damages, even if we have been advised of the possibility of such damages.
18. Indemnification
You agree to indemnify, defend, and hold harmless Modern Apothecary, its owners, officers, employees, agents, and suppliers from and against any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms; (b) your misuse of any product; (c) your violation of any law or regulation; or (d) your violation of the rights of a third party.
19. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of [insert your formation/operating state], without regard to its conflict-of-law principles. Before initiating a formal dispute, you agree to first contact us at [insert support email] so we can attempt to resolve the issue informally.
Any dispute that cannot be resolved informally shall be settled by binding arbitration on an individual (non-class) basis, administered under the rules of a mutually agreeable arbitration organization, except that either party may bring an individual claim in small-claims court where permitted. Each party bears its own costs unless the arbitrator or court awards otherwise. Nothing in this section limits any right that cannot be waived under applicable consumer-protection law.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy and any order-specific terms disclosed at checkout, constitute the entire agreement between you and Modern Apothecary regarding your use of the site and purchase of products, superseding any prior agreements.

By using this site or placing an order, you consent to receive communications from us electronically, including order confirmations, policy updates, and notices. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

California Residents (CCPA/CPRA). If you are a California resident, you have the right to: (a) know the categories and specific pieces of personal information we have collected about you and the purposes for collecting it; (b) request deletion of your personal information, subject to certain exceptions (e.g., completing a transaction, legal compliance, fraud prevention); (c) correct inaccurate personal information; (d) opt out of the “sale” or “sharing” of your personal information, as those terms are defined under California law; (e) limit the use of “sensitive personal information” as defined under California law; and (f) not be discriminated against for exercising any of these rights.
The Modern Apothecary does not sell personal information for monetary consideration and does not share personal information with third parties for cross-context behavioral advertising purposes, as those terms are defined under the CCPA/CPRA. We may share limited information with service providers strictly to operate our business (e.g., payment processing, shipping/fulfillment, and website hosting), which does not constitute a “sale” or “sharing” under California law. If this changes in the future — for example, if we begin using advertising or analytics tools that share data with third parties — we will update this policy and provide the required opt-out mechanism at that time.

We will verify your identity before processing a request and will respond within the timeframes required by law. You may also designate an authorized agent to submit a request on your behalf.
